1. About Us

These Terms and Conditions (“Terms”) apply to the use of this website (the “Site”) and to the sale of goods by Georgina Kate Jewellery Ltd (“we”, “us”, “our”) to you.

By placing an order with us, you agree to be bound by these Terms.

2. Eligibility

By placing an order, you confirm that:

  • You are at least 18 years of age;

  • You are legally capable of entering into binding contracts;

  • The information you provide is accurate and complete.

3. Formation of Contract

3.1 All orders placed through the Site are subject to acceptance and availability.

3.2 After placing an order, you will receive an acknowledgement email confirming receipt. This does not constitute acceptance of your order.

3.3 A contract between you and us is formed only when we dispatch the goods to you and send a dispatch confirmation email.

3.4 We reserve the right to refuse or cancel any order prior to dispatch for reasons including (but not limited to):

  • Product unavailability

  • Pricing or description errors

  • Suspected fraud

  • Payment authorisation failure

If we cancel your order before dispatch, you will receive a full refund.

4. Price and Payment

4.1 All prices are shown in GBP (£) and include VAT where applicable.

4.2 Delivery charges are stated separately at checkout.

4.3 We reserve the right to amend prices at any time, but changes will not affect orders already confirmed.

4.4 Payment must be made in full at the time of ordering.

4.5 We do not store credit card details.

5. Delivery

5.1 Delivery times are estimates only and are not guaranteed.

5.2 Risk in the goods passes to you upon delivery.

5.3 Title (legal ownership) in the goods remains with us until full payment has been received.

5.4 We are not liable for delays caused by events outside our reasonable control (see Force Majeure clause below).

6. Your Right to Cancel (Consumer Contracts Regulations 2013)

6.1 If you are purchasing as a consumer, you have the right to cancel your order within 14 days of receiving the goods.

6.2 To exercise your right to cancel, you must notify us in writing via email.

6.3 You must return the goods within 14 days of notifying us of cancellation.

6.4 Goods must be returned:

  • Unworn

  • In original condition

  • In original packaging

6.5 You are responsible for return shipping costs unless the item is faulty.

6.6 We recommend insured and tracked postage, as we are not responsible for goods lost in transit.

6.7 Refunds will be processed within 14 days of receiving returned goods (or proof of return).

6.8 We reserve the right to reduce the refund if the value of the goods has been diminished through handling beyond what is necessary to establish their nature, characteristics and functioning.

7. Faulty or Misdescribed Goods (Consumer Rights Act 2015)

Nothing in these Terms affects your statutory rights.

If goods are faulty, not as described, or not of satisfactory quality, you may be entitled to:

  • A repair or replacement;

  • A price reduction;

  • A refund.

Claims must be made within a reasonable time of discovery.

8. Product Information

We make reasonable efforts to ensure product descriptions, images and pricing are accurate. However:

  • Colours may vary depending on screen settings;

  • Minor variations may occur in handmade products;

  • Measurements are approximate.

9. Intellectual Property

All content on the Site (including images, branding, logos, designs, text and product designs) is owned by or licensed to Georgina Kate Jewellery Ltd.

You may not reproduce, distribute, modify or commercially exploit any content without our written permission.

10. Account Security

If you create an account, you are responsible for maintaining confidentiality of login details.

We reserve the right to suspend or terminate accounts where there is breach of these Terms or suspected misuse.

11. Limitation of Liability

11.1 Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of statutory consumer rights.

11.2 Subject to clause 11.1, our total liability to you shall not exceed:

  • The price paid for the goods; or

  • £100
    whichever is greater.

11.3 We shall not be liable for:

  • Indirect or consequential losses;

  • Loss of profits;

  • Business interruption;

  • Loss arising from misuse of products.

12. Force Majeure

We are not liable for failure or delay in performing obligations due to events beyond our reasonable control, including but not limited to:

  • Natural disasters

  • Postal strikes

  • Supply chain disruption

  • Government restrictions

  • Cyber incidents

13. Third Party Links

We are not responsible for the content or privacy practices of external websites linked from our Site.

 

14. Privacy

Your personal data is processed in accordance with our Privacy Policy.

15. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force at the time of your order will apply.

16. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
